These Terms of Service govern your access to and use of the website located at www.reicloud.com.au and all software, services, applications and related products provided by REI Master Pty Ltd trading as REI Cloud (“REI Cloud”, “we”, “our”, “us”).
By accessing or using our Services, you agree to be bound by these Terms.
Services
REI Cloud provides cloud-based property management software and related services for accommodation providers, holiday letting businesses, property managers and real estate professionals.
Services may include:
- Property Management Software (PMS)
- Booking and Reservation Management
- Trust Accounting
- Owner Management
- Reporting and Analytics
- Guest Communications
- SMS and Email Messaging
- Integrations with third-party providers
- AI-powered and automation tools
Account Responsibilities
You are responsible for:
- Maintaining accurate account information
- Keeping login credentials secure
- Managing authorised users
- All activity undertaken through your account
You must immediately notify REI Cloud of any suspected unauthorised access.
Licence to Use
REI Cloud grants you a limited, non-exclusive, non-transferable licence to access and use the Services during your active subscription period.
You may use the Services solely for your own business operations.
Prohibited Use
You must not:
- Copy or resell the Services
- Modify, reverse engineer or decompile any software
- Attempt to gain unauthorised access to our systems
- Use the Services in a way that breaches any law
- Upload malicious software or harmful code
- Infringe the intellectual property rights of REI Cloud or any third party
Intellectual Property
All software, trademarks, logos, designs, content, databases and intellectual property associated with REI Cloud remain the exclusive property of REI Cloud or its licensors.
No ownership rights are transferred to you through use of the Services.
Customer Data
You retain ownership of all data entered into the Services.
This includes:
- Guest information
- Property information
- Owner information
- Financial records
- Reservation data
- Operational data
REI Cloud may use Customer Data solely for:
- Delivering Services
- Technical support
- Security monitoring
- Product improvement using aggregated or anonymised data
Data Security
REI Cloud uses commercially reasonable security measures to protect Customer Data.
Customers are responsible for:
- Password security
- User permissions
- Maintaining device security
- Enabling Multi-Factor Authentication where available
Force Majeure
Neither party is liable for delays or failures caused by events beyond their reasonable control including natural disasters, power failures, internet outages, government actions, cyber attacks or telecommunications failures.
Customers remain solely responsible for reviewing and verifying all outputs generated by AI features.
SMS & Messaging Services
Where messaging services are used:
- Customers must comply with the Spam Act 2003 (Cth)
- Customers must obtain all required consents
- Usage fees may apply
- REI Cloud may suspend messaging services where misuse is identified.
AI & Automation Features
REI Cloud may offer automated or AI-powered features.
These features are provided to assist business operations and should not be relied upon as professional, legal, accounting or business advice.
Customers remain solely responsible for reviewing and verifying all outputs generated by AI features.
Service Availability
REI Cloud aims to provide reliable and uninterrupted services.
However, availability may be affected by:
- Scheduled maintenance
- Internet outages
- Third-party service interruptions
- Cybersecurity incidents
- Force majeure events
We do not guarantee uninterrupted service availability.
Limitation of Liability
To the maximum extent permitted by law:
REI Cloud will not be liable for:
- Loss of profits
- Loss of revenue
- Loss of business opportunity
- Loss of goodwill
- Loss of data
- Consequential or indirect losses
Where liability cannot be excluded by law, our liability will be limited to:
- Re-supplying the Services; or
- The fees paid by you during the previous twelve months OR $500 whichever is lesser.
Confidentiality
Each party agrees to keep confidential information received from the other party confidential and not disclose it except:
- As required by law
- With written consent
- To professional advisers
Suspension & Termination
REI Cloud may suspend or terminate access where:
- Fees remain unpaid
- These Terms are breached
- Illegal activity is suspected
- Continued access creates security risks
Upon termination, access to the Services may cease and Customer Data may be deleted after the period specified in our Subscription & Billing Policy.
Changes to these Terms
REI Cloud may update these Terms from time to time.
Governing Law
These Terms are governed by the laws of Queensland, Australia.
Any disputes will be subject to the jurisdiction of Queensland courts.
